These Terms of Use (“Terms”) are an agreement between you and DesignX Inc., 851 W Front St Ste 1501, Boise, ID 83702, United States (“Aspiro”, “we”, “us”), about your use of the Aspiro WINS mobile app and the services behind it (together, the “App”). By creating an account or using the App you agree to these Terms and to our Privacy Policy at https://aspirohealth.com/app-privacy-policy/. If you do not agree, do not use the App.
1. Who can use Aspiro
- You must be at least 16 years old to create an account or use the App. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
- You must give accurate information when you sign up and keep your sign-in details secure. You are responsible for activity on your account.
- One person per account. Do not create accounts for someone else or impersonate anyone.
2. Health and fitness information is not medical advice
- The App, including workouts, programs, nutrition estimates, sleep and recovery summaries and the AI coach, gives general fitness and wellness information. It is not medical advice and does not diagnose, treat, cure or prevent any disease or condition. It is not a medical device.
- Talk to a doctor or other qualified health professional before starting a new exercise or nutrition program, especially if you are pregnant or postpartum, have a medical condition, take medication, or have had an injury. Stop exercising and seek help if you feel pain, dizziness, shortness of breath or chest discomfort.
- Pregnancy and postpartum programs are adapted training only. They do not replace the advice of your doctor or midwife.
- Calorie and nutrient values, including those estimated from a photo or a description, are estimates and can be wrong. Check them before you rely on them.
- If you think you are having a medical emergency, call your local emergency number. If you are in crisis in the US, call or text 988.
3. The AI coach and other AI features
- The AI coach is software. Its replies are generated automatically by third-party AI models (the Privacy Policy names the providers) and can be inaccurate, incomplete or out of date. It is not a doctor, dietitian, therapist or human trainer.
- AI features only send your information after you agree, and you can turn them off at any time in Settings › Coaching › AI features. The rest of the App keeps working without them.
- The coach only changes your records (for example, logging a meal or editing a workout) after you confirm the change on a card in the chat. You are responsible for what you confirm.
- Do not use the coach for emergencies, and do not rely on it for medical, legal or financial decisions.
- AI features are free in this version of the App and have usage limits. We may change the models or limits that power them.
4. Human coaches
You can ask to be matched with a human coach through the App. If you connect with one, that coach can see only the information you allow in Settings › Coaching › Data sharing (described in the Privacy Policy), and you can end coaching at any time. No payment for coaching happens in the App today; if paid coaching is added, we will update these Terms first with its payment and refund terms. Human coaches are independent fitness professionals, not Aspiro employees. They are responsible for the advice they give, and Aspiro is not responsible for it, except where the law says otherwise.
5. Community rules — zero tolerance
Aspiro has social features: teams, challenges, a Community feed, comments, reactions, @mentions, friends and direct messages. Before you first post, comment, message or create a challenge, you agree to our Community rules. We have zero tolerance for objectionable content or abusive users. You agree not to post, send or share anything that:
- harasses, bullies, threatens or intimidates anyone, or targets people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or body size;
- is sexual or sexually suggestive, involves minors in any sexual way, or is an unwanted advance;
- is violent, promotes self-harm or disordered eating, or glorifies dangerous training or drug use;
- is spam, advertising, scams, or links to malicious sites;
- shares someone else’s personal information (including contact details or location) without their permission;
- impersonates another person, brand or Aspiro;
- infringes someone else’s intellectual property or privacy; or
- breaks the law.
You also agree not to: try to meet up with or collect contact details from people you do not know; use bots, scrapers or automated accounts; try to get around blocks, rate limits, filters or moderation; or interfere with the App or its security.
How we enforce this.
- Text you post is checked against a list of words we don’t allow, and new profile, cover and workout photos get an automated safety check. Text that breaks the list is refused; a photo that clearly breaks these rules is hidden right away and reviewed by our team.
- You can report a person, a comment, a post or a challenge, and block anyone. Blocking hides them from you and stops them messaging you; you can unblock in Settings › Privacy & safety › Blocked people.
- Reports alert our moderators at once. We review reports within 24 hours and act on objectionable content by removing it and, where appropriate, suspending or removing the account that posted it. Comments reported by several people are hidden automatically until we review them.
- We may remove content or restrict features (for example, creating challenges) at any time if we believe these rules were broken.
AI-powered community members. The Community may include a small number of AI-powered training buddies operated by Aspiro, not real people, as the Community guidelines in the App say. They may post workouts, react to or comment on workouts you share to Community, accept friend requests and reply to direct messages. If you sincerely ask one whether it is an AI, it will always tell you the truth. They never ask to meet, never ask for contact details, money or photos, and never give medical advice. Do not treat anything they say as coming from a real person or a professional.
6. Your content
- “Your content” means what you put into the App: profile details, photos, workouts, meals, comments, messages, challenges and similar material. You keep ownership of your content.
- You give Aspiro a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display and share your content only as needed to run and improve the App and to show it to the people you choose to share it with (for example, your team, your friends, or Community if you turn sharing on). This licence ends when you delete the content or your account, except for copies we must keep by law.
- You are responsible for your content and confirm you have the right to share it. Do not upload photos of other people without their permission.
7. Purchases and the Aspiro store
- The App has no in-app purchases today. If we add any, they will be billed by Apple and are also subject to Apple’s terms; we will update these Terms first.
- The product store inside the App links out: products are bought on aspirohealth.com in your browser and are sold under that site’s own terms, shipping and refund policies.
8. Apple Health
If you connect Apple Health, the App reads and writes only the data types you allow, as described in the Privacy Policy. You can change this at any time in the iOS Settings app or the Health app.
9. Our intellectual property
The App, including its software, exercise media, programs, text, design and the Aspiro name and logos, belongs to Aspiro or its licensors. We give you a personal, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own non-commercial use, under these Terms and Apple’s Usage Rules. Do not copy, resell, reverse engineer or build a competing product from the App or its content. Food data from USDA FoodData Central and Open Food Facts is used under their open licences.
10. Ending your account
- You can delete your account at any time in the App: Settings › Account › Delete account. Deleting your account deletes your data as described in the Privacy Policy.
- We may suspend or end your access if you break these Terms, if required by law, or to protect other people or the App.
11. Changes to the App and these Terms
We may change or discontinue features. We may update these Terms; if a change is material we will tell you in the App before it takes effect. Using the App after the change means you accept it.
12. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not promise that the App will be uninterrupted or error-free, or that any workout, estimate or AI reply is correct or suitable for you. Some places do not allow these disclaimers, so they may not apply to you.
13. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, ASPIRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR INJURY ARISING FROM EXERCISE OR DIETARY CHANGES YOU CHOOSE TO MAKE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE APP IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law (for example, for fraud, or for death or personal injury caused by negligence where the law does not allow it to be limited), and consumers keep any statutory rights that the law where they live does not allow a contract to take away.
14. Governing law and disputes
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute about the App or these Terms will be brought only in the state or federal courts located in Ada County, Idaho, and you and Aspiro consent to their jurisdiction. If the law where you live gives you rights that cannot be waived by agreement, including the right to bring a claim in your local courts, nothing in these Terms takes them away.
15. Apple-specific terms
These Terms are between you and Aspiro, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims about it (including product liability, legal or regulatory compliance, or intellectual-property claims); Aspiro is. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not in a country under a US government embargo or designated as “terrorist supporting”, and are not on a US list of prohibited or restricted parties. You must also follow any third-party terms that apply when you use the App (for example, your mobile carrier’s).
16. General
If any part of these Terms cannot be enforced, the rest stays in effect. If we don’t enforce a part right away, we have not waived it. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the whole agreement between you and us about the App.
